This appeal is from an order of the trial court setting aside a verdict and granting a new trial in a condemnation action. The defendant has appealed from that order. The new trial was granted upon two grounds, as stated by the court: First, because of misconduct of the jury; *351and second, because of the failure to give two instructions requested by the plaintiff.
This is the second appeal in this proceeding. Upon the. first appeal, which was from the order of necessity and public use, we reversed an order of the superior court and remanded the case to the lower court to determine the damages to…
