Willis Sharpe Kilmer died a resident of Broome County, New York, on July 12,1940, testate, and leaving a gross estate of about $7,000,000. The executors of his will are the City National Bank of Binghamton, Jerome B. Hadsell (since deceased), George M. Ely and Alexander M. Bobb. This is a proceeding brought for an accounting by said executors, instituted for the purpose of winding up their affairs as such and taking over as trustees in accordance with provisions of the will.
