— In an action, inter alia, to recover damages for negligence, the plaintiff appeals from an order of the Supreme Court, Dutchess County (Beisner, J.), entered November 24, 1987, which denied his motion for summary judgment, and granted the cross motion of the defendant Dwyer-Berry Construction Corp. for summary judgment dismissing the complaint as against it.
Ordered that the order is affirmed, with costs.
