This action is brought by the plaintiff, as a creditor and stockholder of the Erie Railway Company, for the purpose, among other things, of compel*178ling "the officers of the company, who are named as defendants, and who are charged in the complaint with having the control of its affairs, to account for their official conduct in the management and disposition of its funds and property, and, upon allegations of abuse of trust and gross misconduct by them, in respect to such funds and property, to obtain their suspension and removal from office.
