We think that the questions presented on this appeal have hereto been adjudicated on the former appeal in this action. Newberry v. Fertilizer Co., 203 N. C., 330.

In the former appeal is the following at p. 338: “When the officer serves a warrant of attachment and a writ of garnishment on a person supposed to be indebted to the defendant in the action, he shall at the same time summon in writing such person as garnishee.
