Plaintiff, administratrix of her husband’s estate, sued defendants to recover damages for the alleged negligent killing of plaintiff’s intes tate. Judgment for plaintiff on the first trial was reversed by this court. Billingsley v. Gulick, 252 Mich. 235. On retrial, there was judgment for plaintiff, and defendants appeal.
The first question presented is the effect on the second trial of the waiver of defendants’ disqualification as witnesses on the first trial, the judgment in which was reversed by this court and the cause remanded for a new trial.
