WISE, Presiding Judge.

The appellant, Craig Newton, was convicted of capital murder for the killing of Charles Whatley. The murder was made capital because he committed it during the course of a first-degree robbery. See § 13A-5-M0(a)(2), Ala.Code 1975. Newton was also convicted of first-degree arson, a violation of § 13A-7-41, Ala.Code 1975, and first-degree theft of property, a violation of § 13A-8-3(b), Ala.
