YEAKEL, Chief Justice.

The State of Texas, at the request of the state treasurer,1 brought this action against the county treasurer and county clerk of Dallas County seeking to compel them to deliver to the State reports of certain unclaimed or abandoned property in their possession, as well as the property itself, specifically unclaimed cash bail bonds, in conformity with the Texas Property Code. See generally Tex. Prop.Code Ann. §§ 71.001-75.102 (West 1995 & Supp.1998). The State filed a motion for partial summary judgment and the Dallas County officials filed a motion for summary judgment.…
