OPINION AND ORDER
LAFFITTE, District Judge.
The parties to this action are not unfamiliar with each other or with the facts of this case. They have met repeatedly in both federal and Commonwealth judicial forums on claims set in identical facts.
On April 27, 1983 plaintiffs, Aida Luz Vega, widow of the deceased, José Tirado; and the deceased’s two minor children, filed a complaint for wrongful death in this Court against defendant, J.C.
