LEWIS, Circuit Judge.
This case arose in the District of Utah as an action for damages for personal injuries sustained by Mrs. Black (plaintiff) occasioned by the negligence of the co-defendants Philco Distributors, Inc. (Philco) and the United States. Jurisdiction was premised on diversity of citizenship in regard to Philco and the claim against the United States was asserted under the Tort Claims Act, 28 U.S.C. §§ 1332, 1346(b), 2674.
