In an action under the Federal Tort Claims Act plaintiff seeks damages for the wrongful death of Donald E. Meeks, a mentally incompetent person under treatment at the Veterans Administration Hospital, Salem, Virginia, who, on the afternoon of October 10, 1959, left the hospital grounds and stood in front of a train resulting in his death.

The case has previously been before the United States Court of Appeals for the Fourth Circuit 1 in reversing the action of the trial court which granted summary judgment for the defendant. 2 Plaintiff contends that the language…
