ROBERTSON, Judge.
The plaintiff-appellants Bryant Downing, Randall Applegate and David Kittle appeal from the trial court's granting of summary judgment in favor of the defendant-appel-lee City of Columbus, Indiana.
We reverse and remand in part and affirm in part.
The factual basis of this appeal is that the three appellants are employed as police officers by the City of Columbus. They are also members of the Indiana National Guard.
