*297Appeal by the defendant from a judgment of the Supreme Court, Westchester County (Perone, J.), rendered December 21, 2001, convicting him of murder in the second degree, attempted murder in the second degree, criminal use of a firearm in the first degree, and criminal possession of a weapon in the second degree (two counts), upon a jury verdict, and imposing sentence.

Ordered that the judgment is reversed, on the law, and a new trial is ordered.
