Defendant in error, plaintiff below, instituted this suit against Grand Prairie Gravel Company, a corporation, W. G. Liggett, E. A. Liggett, and C. C. Houston, as trustees. Plaintiff alleged that the corporation of the Grand Prairie Gravel Company, which was organized under the laws of the state of Texas, had been dissolved, and that said corporation, through its officials, had filed with the secretary of state of the state of Texas, a notice of such dissolution, in compliance with the statutes of the state of Texas, and that no receiver'had been appointed for said corporation; that W.
