Reversing.

On December 23, 1923, Victor A. Burnett was shot and killed by Butler Bales, a policeman of tbe city of Pikeville. He bad theretofore insured bis life witb appellant company in tbe sum of $2,500.00, which sum tbe company duly paid to Burnett’s widow, the beneficiary of the policy and the appellee herein. By the terms of this policy it was provided, among other things, that the appellant would pay £ ‘ double the sum of this policy or $5,000.00 in lieu of all other benefits in the event of the death of the insured being caused by bodily injury…
