Affirming in part and reversing in part.

In the recent primary election for the Republican, nomination for magistrate in one of the districts of Pike county, D. C. Mounts received 313 votes; L. W. So wards, 285; and R. R. Hatfield, 270. Three other candidates received fewer votes. Mounts was given a certificate of nomination, and in due time Hatfield instituted a contest against him and Sowards.
