This is an appeal by the defendant from a judgment entered in favor of the plaintiff, and from the order denying a new trial.

The action was instituted by the plaintiff to quiet title to an undivided half interest in four certain lots in the city of Chamberlain, in this state, under the provisions of chapter 8i, Laws of 1905, and the complaint is. in the usual form. The defendant, Tidrick, in his answer, alleges that he was the owner in fee simple of the undivided one-half of the lots; that the title of the aforesaid property was vested in one John B.
