SUMMERS, Justice.

We granted writs in these consolidated cases to resolve a conflict between decisions of the First and Second Circuits on the question of whether a jury trial may be had in a case in which a public body is a party to the principal demand. 251 La. 1079, 208 So.2d 536 (1968).

In Abercrombie v. Gilfoil, La.App., 205 So.2d 461 (1967) the First Circuit held that because La.R.S. 13:5104 prohibits a jury trial of a suit against a public body, a jury trial could not be granted as to any of the defendants in a suit in which the Highway Department was one of several defendants against…
