KRUEGER, Judge.

The appellant was tried and convicted of ¿he oifense of an assault with intent to murder, and his punishment assessed at confinement in the State penitentiary for a term of two years.

It appears from the record in this case that the appellant was in charge of and lived on Dillard Barrow’s farm which was located on the south side of Atascosa creek and which was its northern boundary. The alleged assaulted party, Ivy Wilburn, lived on his father’s farm which was located on the north side of said creek and which was its southern boundary. Between the two farms there was a water…
