This is a suit by appellee against Charles O. Austin, banking commissioner of Texas, the state banking board, and the First State Bank of Rio Hondo, to recover the sum of $1,478.11, an insured deposit in the said bank, which was organized under the depositors’ guaranty bank fund, and that said bank had failed and been taken over by said banking commissioner and state banking board for the liquidation of its debts, and that said commissioner and board had rejected the claim of appellee as a depositor and claimant in the depositors’ guaranty fund.
