OPINION, FINDINGS OF FACT and CONCLUSIONS OF LAW.

LEVET, District Judge.

This is an action for alleged infringement 1 2 of a trademark and service mark 2 registered in the United States Patent Office, and an alleged violation of the New York General Business Law, § 368-d, the dilution statute. 3 The only remedy plaintiff seeks is a permanent injunction prohibiting defendant and its members from using defendant’s trademark, also registered in the United States Patent Office.
