Maris, as plaintiff, recovered judgment at the April Term 1874 of the district court against the Railroad Company, for $208.25, and costs, and the Railroad Company brings the case here on error.

statement of facts. This was an action bi’ought by defendant in error to recover for goods destroyed by fire in a depot belonging to the plaintiff in error, and the question is, whether the company at the time of the fire occupied toward the goods the position of carrier, or that of warehouseman. The case was tried upon an agreed statement of facts. It is not contended that the fire was caused by the negligence of the company, op that if its liability as carrier had terminated it was responsible for the loss. The material facts are these:…
