On or about the 24th of May, 1861, certain household furniture, belonging to the plaintiff, was delivered to the defendant, marked and directed to F. P. Fenner, Dunkirk, FT. Y., and the defendant carried said furniture over its railroad to Dunkirk. The furniture was in fact in course of transportar tion to Sinelairville, Chautauqua County, H. Y., a place a short distance from Dunkirk, but this fact was not known to the defendant until after the arrival of the furniture at Dunkirk.
