This is a bill in equity for ah injunction to restrain the defendants from erecting a building in the bed of what is alleged to be a street of the City of Philadelphia, and to order the defendants to remove a fence erected by them across said alleged, street. The pleadings consist of the bill of complaint, answer and plaintiffs’ reply to new matter set forth in the answer. The issues raised are as to whether the land upon which the building is to be erected by the defendants has become a public street in which the plaintiffs have any rights,-and whether, if they have such rights,…
