MEMORANDUM OPINION

This matter is before the Court on Defendant’s Motion to Dismiss and on Plaintiffs Motion for Extension of Time and Request for Court-Appointed Counsel. For the reasons stated below, the Court will grant Defendant’s motion and deny Plaintiffs motions.
