I can only respectfully suggest that the majority decision and the basis for it takes considerable liberties with the facts and the existing law.

This is a case concerning the power of eminent domain. The majority’s decision is unusual, because it concludes the power exists because the “[principal proof, is that the main purpose of the project is for water supply to municipalities.” That statement is contrary to facts found by the trial court and irrelevant to the law of eminent domain.
