SEYBERT, District Judge.

William Makransky (“Plaintiff”), a convicted sex offender, filed a visa petition on behalf of his wife, a foreign national. When the petition was denied, Plaintiff sued the director of the United States Citizenship and Immigration Services (“USCIS”) and other federal officials asserting violations of his constitutional rights and the Administrative Procedure Act (“APA”), 5 U.S.C. § 500 et seq. Defendants have moved to dismiss the Complaint for lack of subject matter jurisdiction and for failure to state a claim.1 (Docket Entry 12.) For the following…
