Motion Nos. 85 and 86 on the calendar of February 4, 1981 are consolidated for disposition. This action for declaratory judgment and permanent injunction concerns New York City’s policy of limiting half-fare privileges on its mass transit system during nonpeak hours to the elderly who are residents of the city.
