This appeal has been taken from a judgment of the Lake County Court of Common Pleas. Following an abbreviated jury trial, appellant, Tonya L. Phillips, was found guilty of theft, under R.C. 2913.02(A)(1). This conviction was based upon an incident in which she was arrested for allegedly shoplifting certain items at a department store. This was the second trial in this matter, as the trial court granted appellant’s motion for a new trial after the first trial in which appellant was found guilty of theft.
