RKUHN, Judge.

This matter is before us on a grant of certiorari. This writ involves the issue of whether the trial court erred in denying an exception of prescription based on La. R.S. 18:5107(D). Finding no error, we affirm.

FACTS

On June 12, 1996, plaintiffs, Braxton Sam and Bertha Sam, filed a 1983 action against relators, the Town of Baldwin, Police Chief Gerald Minor, and Officer David Bruner1, seeking damages arising out of an incident which occurred on July 4, 1995.2 Plaintiffs requested that service be held.
