On February 8, 1923, the plaintiffs, together with Annon Fenimore and Elmer Fenimore, acquired title to about 275 acres of land which is in controversy herein. The five executed jointly a mortgage for the purchase price thereof to the Security Loan & Title Company of Winterset, Iowa, for the sum of $10,000. The indebtedness thus secured was represented by three promissory notes, one for $2,000, one for $3,000, and one for $5,000. These notes and mortgage all bore date February 16, 1923.
