INTRODUCTION

Plaintiff Lexion Medical, LLC (“Lex-ion”) and Defendant SurgiQuest, Inc. (“SurgiQuest”) manufacture and sell in-sufflation devices used in laparoscopic surgery.1 Lexion commenced the instant action against SurgiQuest in September 2013, alleging that SurgiQuest had made false representations while advertising and marketing its insufflation device.
