I. INTRODUCTION
On December 1, 1999, Ray Cabiness (“petitioner”) was sentenced to 171 months imprisonment following his conviction for carjacking, use of a firearm during a crime of violence and possession of a firearm by a convicted felon. On August 10, 2000, the United States Court of Appeals for the Third Circuit affirmed petitioner’s judgment of conviction and sentence on direct appeal.
