I. INTRODUCTION

Plaintiff Nancy S. Dietz (“plaintiff’) brought suit against defendants James M. Baker (“Mayor Baker”), individually and in his official capacity as the Mayor of the City of Wilmington, and the City of Wilmington (“City”) (collectively, “defendants”) asserting violations of 42 U.S.C. §§ 1981, 1983 and Title VII.
