MARTIN, Justice.

Appellant, Walter Davies, sued appel-lees, Esther Agnes Stiff, a feme sole, and the Commissioner’s Court of Lubbock County, Texas alleging that he had been elected to the office of County Treasurer of Lubbock County in the November, 1954 general election and was entitled to such office. The facts in the cause on appeal have been stipulated and will be briefly outlined.
