This suit was brought by Ealph M. Hoyt, in the circuit court of McLean county, against the Chicago and Alton Bail-road Company. It was brought to recover for personal injuries sustained by plaintiff, alleged to have been caused by the negligent conduct of defendant’s servants in charge of a freight train. The judgment rendered in the circuit court, in favor of plaintiff, was affirmed in the Appellate Court, and as the case comes before this court, only questions of law can be considered.
