At the time the injury complained of

in this litigation was inflicted the Atchison & Eastern Bridge Company was engaged in the erection of false w ork essential to the reconstruction of a bridge across the Missouri river at the city of Atchison. The false work served as a substructure of the old bridge during the dismantling process, of the new bridge as piece by piece it replaced the old one, and of a temporary bridge for highway purposes alongside the bridge proper, over which railway traffic was not interrupted.
