Plaintiff brought the present action against one Abraham Wolfe and the defendant, appellant, to recover the sum of $10,335.67, besides interest, alleged to be due from said defendants upon a contract entered into by said defendants with the creditors of a corporation known as Wolfe & Glassberg, Inc., February 16, 1929, whereby it is alleged the defendants obligated themselves to pay to the creditors of Wolfe & Glassberg, Inc., the total amount of their claims against said corporation, amounting to $12,935.67, $2,000 of which, it is alleged, under the terms of said agreement was to be paid to…
