OPINION

WIESE, Judge.

This case is before the court on defendant’s motion to dismiss the complaint for *601lack of subject matter jurisdiction, or, in the alternative, for summary judgment. Oral argument was heard on November 18, 2002. For the reasons set forth below, defendant’s alternative motion for summary judgment is granted with respect to plaintiffs claim of duress, and defendant’s motion to dismiss for lack of subject matter jurisdiction is granted with respect to all other claims.
