The Commonwealth entered into contracts subject to appropriation with eleven counties and the town of Nantucket for the lease of courthouse facilities and services for fiscal years (FY) 1990 and 1991 pursuant to G. L. c. 29A, § 4 (1988 ed.). The Legislature did not appropriate full funding for the leases for either year. The counties filed a complaint in the Supreme Judicial Court for Suffolk County pursuant to G. L. c. 211, § 3 (1988 ed.), requesting us to use our supervisory power to order the Commonwealth to pay the full amount of rent owed or, in the alternative, to require the judiciary…
