Appeal from a judgment of the County Court of Franklin County (Plumadore, J.), rendered February 28, 1985, upon a verdict convicting defendant of the crime of murder in the second degree.
The instant case involves a shooting incident which occurred early in the morning on September 2, 1984 and resulted in the death of Bernard Lyon. The facts surrounding the incident as gleaned from pretrial and trial testimony are as follows.
