This is an original proceeding in this court in prohibition. Our provisional rule issued to which return has been made. The facts are admitted.

On August 16, 1938, information was filed in the Probate Court of Dallas County alleging that W.T. Finley, a resident of said county, was a person of unsound mind and incapable of managing his affairs and praying that an inquiry thereinto be had, as authorized by Section 448, Revised Statutes 1929 (Mo.
