Accused was indicted for murder, and was convicted of manslaughter in the' first degree, -from which judgmefit of conviction he appeals.' There ■ivas ño questibii 'or dispute that defendant killed 'the deceased, intentionally, byshooting him-with a: gun'and a *85pistol.
