OPINION

SEERDEN, Justice.

This is a summary judgment case. Appellant’s cause of action is based upon the claim for damages resulting from appel-lee’s alleged fraud and misrepresentation in connection with her execution of certain notes individually and in her capacities as administratrix of the estates of her son, John Bixenstine, and husband, Cyril Bixen-stine, both deceased. Though the suit originally included other parties, all claims have been disposed of except those concerning appellee, Fred Palacios. Summary judgment was granted in his favor. We reverse the judgment and remand this case…
