TMs is a consolidated appeal from judgments entered pursuant to verdicts of the jury in favor of plaintiffs and from orders denying motions for a new trial.

The action arises out of a rear-end collision between a car driven by Gerald Atkinson, referred to hereinafter as plaintiff, in which his brother Archibald Atkinson was riding as a passenger, and an automobile owned by Max Mock and driven by William Mock, referred to hereinafter as defendant.
