MEMORANDUM
CAMPBELL, District Judge.
I. Introduction
Abu-Ali Abdur’ Rahman, Petitioner, has been sentenced to death for first degree murder. He has filed a Petition for a writ of habeas corpus, pursuant to 28 U.S.C. § 2254, challenging both his conviction and sentence. Currently pending before the Court for decision is Petitioner’s First Motion For A Partial Summary Judgment (Docket No. 88). The Motion seeks summary judgment on two issues regarding the Tennessee trial court’s jury instructions at sentencing: (1) “heinous, atrocious, or cruel” aggravating circumstances; and (2) “unanimity.” For…
