This is the second time this case has come before us. It is a suit by a real estate broker who j oins with the owner of certain property situated on Tulane Avenue in the City of New Orleans to enforce the obligation of the defendant under a written contract dated July IS, 1954, in which the latter offered to purchase the property for $35,000, to be paid on terms specified therein.
