MEMORANDUM OPINION
TOLEDO, District Judge.
Petitioner submitted to the Court an oral Motion to Dismiss the Indictment for lack of jurisdiction alleging that the securities involved in the case against him, because of their particular or unique nature, were traveler’s checks and subject to Section 2314, paragraph 4 of Title 18, United States Code. Since the petitioner had been charged under Title 18, Section 2314, paragraph 3, petitioner alleged that he had been erroneously charged and, therefore, the Indictment should be dismissed.
