I concur in,the proposition announced in the syllabus, and in the result reached in the opinions prepared by my associates Mr. Justice Robinson and Mr. Chief Justice Bruce. I desire, however, to base my conclusion upon somewhat different grounds. And in view of the importance of the questions involved, I deem it my duty to discuss these at some length.
