This is an action of contract brought to recover certain instalments of the Federal income tax assessed against the plaintiff on account of rental received by it from the defendant. ' The case was heard upon a demurrer to the declaration. The allegations in brief are that both the plaintiff and the defendant are corporations organized under the laws of Massachusetts.
